Summary:On 26 April 2005 the Commission received a reference from the Attorney General, the Hon. Jim McGinty MLA, to examine and report upon the law of homicide in Western Australia. In particular, the Commission was asked to give consideration to: (i) the distinction between wilful murder and murder; (ii) the defences or partial excuses to homicide, including self-defence and provocation; (iii) current penalty provisions relating to the law of homicide; and (iv) any related matter. The Commission was further asked to report on the adequacy of the existing law, practices and procedures in relation to homicide offences and defences and the desirability of changes to those laws.
