Summary:"This book is primarily intended to guide public bodies on the best practices to adopt to avoid, mitigate and, if need be, defend against a public-sector personal-information class actions. It also explores some of the more philosophical questions to which this form of legal action in the public sector gives rise. It reviews and compares the access to information and personal-information protection regimes applicable to federal and provincial public sector entities across Canada in the context of class actions. It also addresses personal health-information processing across Canada. The work is divided into four parts. It begins by reviewing the legislation applicable to personal -information protection in the public sector - including the health care sector- and to class actions. It then addresses certain governance issues that recent legislation and technology have rendered imperative. The third and fourth parts discuss operational challenges posed by present and emerging technologies that, if not addressed appropriately, will expose entities to legal action. It suggests measures that can be implemented to mitigate damages in these areas.
